Terms of Use

Both of our apps are one-time purchases with no subscription, no account, and no data sent anywhere. These terms explain what you are agreeing to, and what we are not promising.
These terms cover the apps published by Onyx One LLC: Daybreak: Sobriety Companion and Debt Free Date: Snowball. By downloading or using either app you agree to them. If you do not agree, please do not use the app.
What these apps are
Both are self-contained tools that run on your device. Neither is a service, and neither connects to anything we operate. What that means differs by app.
Daybreak: Sobriety Companion
Daybreak is a supportive tool. It counts the time since a date you chose, holds what you wrote about why, and gives you somewhere to go in a hard moment.
Daybreak is not medical care, therapy, or treatment, and it is not a substitute for any of them. It does not diagnose, and nothing in it is clinical advice. Recovery from a substance use disorder is something to work through with people qualified to help — a doctor, a therapist, a counsellor, a sponsor, a support group.
Daybreak is not an emergency service. Its hard-moment screen dials a phone number that you entered yourself; it does not contact us, and no one is monitoring it. If you are in danger or in crisis, contact your local emergency number or a crisis line directly. In the United States, call or text 988.
Withdrawal from alcohol and some other substances can be medically dangerous. Do not use a counter in an app as a reason to stop something abruptly without medical advice.
Debt Free Date: Snowball
Debt Free Date is a calculator. You enter your own balances, interest rates and minimum payments, and it projects when those debts would be paid off.
Its projections assume you make exactly the payments you enter, every month, on time. They do not account for fees, interest rate changes, promotional rates ending, late charges, missed payments, or anything your lender may do. Real lenders compound interest in ways that differ between products and jurisdictions; the app uses a standard monthly approximation.
Debt Free Date is not financial advice. It is not a substitute for guidance from a qualified financial professional, an accountant, or a non-profit credit counsellor, and Onyx One LLC is not a financial adviser, lender, broker or debt management service. Decisions about your money are yours. For advice on your specific situation, talk to someone qualified to give it.
Your data
Everything you enter stays on your device. There is no account, no server and no copy we can read. If you delete an app, that data goes with it and we cannot recover it, because we never had it. See the Privacy Policy for the detail.
Keeping your own records is your responsibility. Neither app is a system of record — your lender's statements are the record of your debts, and your own notes or your care team are the record of your recovery.
Purchases
Both apps are free to download, and each offers a one-time purchase that unlocks additional features. Neither is a subscription and neither recurs.
Payment is taken by Apple or by Google, not by us. Refunds are handled by the store you bought through, under its policies — we cannot issue one directly:

Restoring a previous purchase on a new device is built into each app, under Settings. A purchase made on one store cannot be restored on the other — they are separate accounts and separate transactions.
Acceptable use
Please don't reverse engineer, decompile or attempt to extract the source of either app, resell or redistribute it, or use it for anything unlawful, except where your local law gives you a right that these terms cannot remove.
No warranty
The apps are provided "as is", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that either app will be uninterrupted or error-free, that Debt Free Date's calculations will match any particular lender's figures, or that Daybreak will produce any particular outcome.
Limitation of liability
To the fullest extent permitted by law, Onyx One LLC is not liable for any indirect, incidental, special or consequential loss, for any financial decision made in reliance on Debt Free Date's projections, or for any health or personal outcome connected with the use of Daybreak. Where liability cannot be excluded, it is limited to the amount you paid for the app in question.
Some jurisdictions do not allow certain exclusions, so parts of the two sections above may not apply to you. Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.
If these terms change
Updated terms will be posted on this page with a new date at the top. Continuing to use an app after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Montana, United States, without regard to conflict of law rules.

Additional terms for the Apple App Store
These apply if you obtained an app from the App Store, and are included because Apple requires them of any developer supplying their own licence terms.
- This agreement is between you and Onyx One LLC only, not with Apple. Apple is not responsible for the app or its content.
- Your licence is a non-transferable licence to use the app on any Apple-branded product you own or control, as permitted by the App Store Terms of Service.
- Onyx One LLC is solely responsible for support and maintenance. Apple has no obligation to provide any support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind.
- Onyx One LLC, not Apple, is responsible for any claim relating to the app, including product liability, failure to conform to a legal requirement, and claims arising under consumer protection or similar legislation.
- Onyx One LLC, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
- You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Additional terms for Google Play
If you obtained an app from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to this agreement and is not responsible for the app.
